Introduction

These Terms and Conditions (the "Terms") govern your download, access, and use of Somnia: Dream Insights (the "App"), published by ORVLI. By using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

Where the App is downloaded through Apple's App Store, Apple's Standard Licensed Application End User License Agreement also applies to the extent required. If these Terms conflict with mandatory store terms or consumer law, the mandatory terms control.

1. Eligibility and License

You must be at least 13 years old to use Somnia. If you are under the age of legal majority where you live, a parent or legal guardian must authorize your use.

ORVLI grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the App on devices you own or control, subject to these Terms and applicable store rules. No ownership rights are transferred to you.

2. Acceptable Use

You agree not to:

  • Use the App unlawfully or to infringe another person's privacy, intellectual property, or other rights
  • Submit content you do not have the right to process
  • Reverse engineer, copy, resell, or attempt to extract the App's source code except where law expressly permits it
  • Bypass limits, access controls, subscriptions, or security measures
  • Send automated, excessive, harmful, or abusive requests, or disrupt the App or its providers
  • Use AI output as professional advice or for unlawful, deceptive, or harmful activity

3. Anonymous Identity, Storage, and Availability

The current release may create an anonymous installation identifier to operate the App. It does not offer a user-facing cloud-sync account, and dream records are stored locally on your device. Keep your own exports of content you want to preserve.

Features, AI models, usage limits, ads, provider availability, and supported platforms may change, be rate-limited, or become unavailable. We may maintain, modify, suspend, or discontinue a feature where reasonably necessary, subject to rights that cannot legally be waived.

4. Subscriptions and Purchases

Somnia may offer recurring Premium subscriptions and one-time purchases through Apple or Google. The applicable store displays the current price, currency, billing period, trial terms, and included benefits before you confirm a purchase.

  • Recurring subscriptions automatically renew unless you cancel them through your store account before renewal
  • Deleting the App does not cancel a subscription
  • Billing, cancellation, refund, and family-sharing rules are administered by the store and mandatory consumer law
  • Restoring a purchase requires the same store account used for the original transaction
  • Ad-removal and Premium benefits apply as described on the purchase screen and may depend on a valid entitlement

5. Your Content

You retain your rights in the dreams, notes, and other content you create. You grant ORVLI and its processors a limited permission to transmit, host, transform, and process content only as needed to provide the feature you request, operate and secure the App, and comply with law.

ORVLI does not currently use dream content to train AI models. You remain responsible for your content, for making your own backups, and for ensuring that your content and use of generated output do not violate law or third-party rights.

6. AI Features and Important Disclaimer

Somnia uses third-party AI services to generate interpretations and images. Output is probabilistic and may be incomplete, inaccurate, offensive, unexpected, or unsuitable. Similar or identical output may be generated for other users.

Interpretations and visualizations are provided for entertainment and self-reflection only. They are not medical, psychological, psychiatric, religious, legal, financial, or other professional advice. Somnia is not a diagnostic, treatment, crisis, or emergency service. Seek a qualified professional or local emergency service when appropriate.

7. Advertising and Third-Party Services

Eligible free-tier users may see third-party ads. The App also depends on services for AI processing, anonymous identity, installation registration, purchases, notifications, and device features. Your use of those services may be subject to separate provider and store terms. ORVLI is not responsible for third-party services outside its reasonable control.

8. ORVLI Intellectual Property

The App, Somnia and ORVLI names and branding, interface, software, visual design, and ORVLI-provided materials are owned by ORVLI or its licensors and protected by intellectual-property laws. You may not use them except as permitted by these Terms or with prior written permission.

9. Privacy

Our Privacy Policy explains how information is handled, including local dream storage, anonymous installation data, AI processing, advertising, permissions, retention, deletion, and your choices.

10. Suspension and Termination

You may stop using the App at any time. We may suspend or terminate access when reasonably necessary to address misuse, security threats, legal obligations, provider restrictions, or a material breach of these Terms. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

11. Disclaimers

To the maximum extent permitted by law, the App and its output are provided "as is" and "as available" without warranties of accuracy, reliability, availability, fitness for a particular purpose, or non-infringement. We do not guarantee that dream data or generated results will never be lost, interrupted, or changed.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by law, ORVLI and its licensors and providers will not be liable for indirect, incidental, special, consequential, exemplary, or lost-data damages arising from the App. Any liability that cannot be excluded remains limited only to the extent permitted by applicable law.

13. Applicable Law and Disputes

These Terms are governed by applicable law, without depriving you of mandatory consumer protections available where you live. Before starting a formal claim, please contact us at info@orvli.tech so we can try to resolve the issue informally. Nothing here limits rights that cannot legally be waived.

14. Changes to These Terms

We may update these Terms when the App, providers, or law changes. We will revise the date above and provide additional notice when required. Your continued use after updated Terms take effect means you accept them, except where law requires another form of consent.
